Introduction

The purpose of the following lists is to illustrate the process whereby the offices of lieutenant and custos rotulorum of the counties of England and Wales, except for Durham and Lancashire, came to be concentrated in the same hands. The office of custos was of much greater antiquity than that of lieutenant which became a permanent feature of county government only from the latter part of the sixteenth century. Before the Restoration the offices were rarely, if ever, held concurrently. In the case of only three counties, Hertford, Lincoln and Suffolk, can an invariable association be traced as far back as 1660. The process was not complete until 1828 when the lieutenant of Stafford was appointed custos of the county.

In order to indicate in each case when the assimilation took place the holders of the office of custos are listed alphabetically by county, first for England and then for Wales, from 1660 to the date from which the two offices have invariably been held concurrently. Until 1689 the custos was appointed by the insertion of his name in the commission of the peace for the county in question and noted in the crown office docket book. In 1689 it was provided that appointments should be made by commissions under the great seal which are enrolled on the patent rolls. The custodes for Durham and Lancashire, who were appointed in a different manner, are not included in the lists. Information about the holders of the office of lieutenant is derived from List of Lieutenants of Counties of England and Wales 1660-1974, compiled by J.C. Sainty (List & Index Society, special series, vol. 12, 1978); that relating to peers from the Complete Peerage.

Middlesex (1794)

In 1670 the 1st Earl of Craven, who had been appointed lieutenant in 1669, was appointed custos. The offices were held concurrently from then until the death of the 1st Duke of Northumberland in 1786. The lieutenancy was then left vacant until 1794 while the office of custos was conferred on Henry Dundas in 1793. In 1794 the Marquess of Titchfield was appointed to both offices which were held concurrently thereafter.

Northumberland (1802)

In 1676 the 2nd Duke of Newcastle, who had been appointed custos 1675, was appointed lieutenant. The offices were held concurrently until 1798 when the 2nd Duke of Northumberland resigned that of lieutenant which remained vacant until 1802. He retained that of custos until 1800 when he was replaced by the 3rd Duke of Portland. In 1802 the 2nd Duke of Northumberland was reappointed to both offices which were held concurrently thereafter.

Stafford (1828)

In 1689 the 7th Baron Paget was appointed lieutenant and custos. The offices were held concurrently until 1801 when Earl Gower who had been appointed to both offices in the previous year relinquished that of lieutenant to the 1st Earl of Uxbridge while retaining that of custos. The 2nd Earl Talbot succeeded Uxbridge as lieutenant in 1812 and Gower, now Marquess of Stafford, as custos in 1828. The offices were held concurrently thereafter.
