Justices in Eyre 1509-1840

Introduction

Some account of the early history of the justices in eyre may be found in G.J. Turner, 'The Justices of the Forest South of Trent,' English Historical Review, xviii (1903) 112-16.

By 1509 it had long been the practice for there to be two such justices, one with jurisdiction north and the other with jurisdiction south of the Trent. Appointments to both offices were made by letters patent under the great seal. Tenure of the northern office was for life until 1689 and during pleasure thereafter except in the case of the Duke of Newcastle (1711) and John Charles Villiers (1790) who were appointed for life.

Tenure of the southern office was for life until 1660, during pleasure 1660-1769 and again for life thereafter. Each justice received a salary of £100. The southern justice was usually granted an additional allowance of 100 marks.

In 1817 statutory provision was made for the abolition of the offices on the termination of the interests of those then in possession (57 Geo. III, c. 61). Accordingly the northern office ceased on the death of the Earl of Clarendon in 1838 and the southern on the death of Thomas Grenville in 1846.
